Student Discipline Policy
DISCIPLINE CODE
In conjunction with the Code of Student Conduct established by the Aiken County
Public School Board, students are expected to exercise the highest standards of
respect, manners, courtesy, sportsmanship, and self-discipline; all of which minimize
the need for external rules and controls.  The following are expectations of students
while under the jurisdiction of LBC Middle School:
In order to ensure greater uniformity in handling student misdemeanors, the following
code is subscribed to and will be enforced by the teachers and administrators of this
school.  These rules are effective during the following times and in the following
places:
1.
On the school grounds during and immediately before or immediately
after school hours
2.
       On the school grounds at any other time when the     
           school is being used by a school group
3.
Off the school grounds at a school activity, function, or event
4.
En route to and from school.
A.
DISORDERLY CONDUCT - LEVEL I
1.
Disorderly conduct (lesser offense) is defined as student behaviors which
tend to impede orderly classroom procedures, instructional activities, or
operation of the school.
2.
The offenses and the actions taken are as follows:
     A.
Use of offensive, abusive, obscene, or profane language or gestures to
any student
    B.
   Dishonesty in any form (i.e. cheating on examinations, classroom
assignments, etc.)
         C.
Being in an off limits area
D.
Willfully defacing property (vandalism-up to $10 in damages)
E.
Stealing (items up to $10)
F.
Being late to in-school suspension.
G.
Disruption of class
H.
Loitering in the corridors/restrooms during class
I.
Sleeping in class
J.
Running in the halls
K.
Throwing rocks, books, and/or other objects
L.
Chewing gum in the building
M.
Being in an unauthorized area such as, but not limited to, going to
any location not indicated on hall pass
N.
Violating dress code such as, but not limited to, wearing hat, cap, or
sunglasses in the building
O.      Sharing locker with another student
P.      Eating/drinking in the building outside the cafeteria
Q.     Possessing a radio, tape player, CD player, or handheld game
R.      Misbehaving in the library, hall, etc.
For each infraction above, the student shall be assigned one (1) day of lunch
detention. If a student fails to show up for lunch detention: 1st Offense –
Student will be written up for one extra day of lunch detention in addition to
original day. 2nd Offense – Student will be written up and will serve an
automatic 2 days of ISS.
S. *Tardiness to class or school without an acceptable excuse
T. **Misbehaving in classroom (interfering with the instructional process)
U.   Any misdemeanor not specifically enumerated.
Level I violations will NOT be erased after the completion of the nine week period. All
Level I offenses will progress towards suspension.  Isolations/suspensions will occur
on the seventh write up for Level I offenses.  The fourth suspension will result in a
suspension AND possible recommendation for expulsion.
If a student is assigned in-school suspension (ISS) or isolation, (1) the student must
return a copy of the letter of suspension signed by the legal guardian, and (2) the legal
guardian must call the school and talk with the administrator in charge of discipline. 
Failure to do both will result in the student’s being suspended out-of-school until a
parent comes to school for a conference.  A legal guardian is required to come to
school for all out-of-school suspensions (OSS).
*A student will be allowed one (1) tardy per class per nine weeks.  On the
second tardy to class and each time thereafter, he/she will be assigned lunch
detention.  If a student is tardy to school, a doctor’s note and a court order are the only
acceptable excuses.  Habitual tardiness to school may result in a suspension or other
actions as deemed necessary by the attendance clerk and or administration.
**Each time a student misbehaves or disturbs the learning process, he/she will
be assigned a lunch detention.
LEVEL I VIOLATIONS WILL NOT BE DROPPED AT THE END OF EACH NINE
WEEKS
School administrators shall have the right to make allowance or change as deemed
necessary in addressing discipline issues.
B.
DISRUPTIVE CONDUCT-LEVEL II
1.
Disruptive conduct (major offense) is defined as those student activities or
behaviors which are directed against persons or property, and the
consequences of which tend to endanger the health and safety of oneself
or others in the school.  Some instances of disruptive conduct may
overlap certain criminal offenses, justifying both administrative sanctions
and court proceedings.  Disorderly conduct (Level I) may be reclassified
as Disruptive Conduct (Level II) if it occurs four or more times.
2.
Acts of disruptive conduct may include, but are not limited to:
A.
Leaving school without permission from proper authority
B.
Forging or falsifying a note and/or excuse for absence, tardiness, or
dismissal
C.
Leaving the classroom without permission
D.
*Cell phone /electronic device violation
E.
Possession of cigarette paraphernalia
F.
   Use of tobacco products
G.
   Physical display of affection
H.
   Cutting classes
*We will follow the Aiken County Board of Education Cell Phone Policy.
TYPES OF DISCIPLINARY ACTION(S) TO BE TAKEN RELATIVE TO A THROUGH H
LEVEL II OFFENSES LISTED ABOVE:
Any four (4) suspensions (bus, ISS, or OSS) will result in a recommendation for
expulsion.
*
First offense: 2 days isolation
*
Second offense: 2 days ISS (even if isolation is reduced)
*
Third offense: 3 days of ISS
*
Fourth offense: 5 days of OSS
*
Fifth offense: 2 to 10 days OSS and possible recommendation for expulsion
*
Sixth offense: 3 to 10 days of OSS and possible recommendation for expulsion
*
Seventh offense: Up to 10 days OSS with possible recommendation for expulsion.
*
Eighth offense: 10 days OSS and recommendation for expulsion.
I.
Blackmail, threats, personal abuse, intimidation of students
J.
Fighting (The punishment for fighting shall be determined by the
administration based upon the severity and intensity of the fight,
and upon the cooperation of those involved.  In an extreme case,
for example, expulsion might be recommended on the first offense.)
K.
Stealing-up to $10 (second and each subsequent offense)
L.
Refusal to cooperate with school personnel or agents (such as
volunteer aides or chaperones, etc.)  whose responsibilities include
supervision of students
M.
Illegally occupying or blocking in any way school property with the
intent to deprive others of its use
N.
Unlawful assembly or disruption of lawful assembly
O.
Willfully destroying property (vandalism-$10 to $50 in damages)
P.
Influencing other students (Any student, or students, who shall
knowingly and willingly encourage, aid, counsel, advise, assist, or
cause any other student or students to violate the provisions of the
Code shall be subject to the same penalties as the student, or
students, who actually committed the violation.)
Q.
Disrespect, rudeness, etc, (insolence) to any member of the staff
R.
Any other acts as determined by the principal.
Relative to the above list (A through R), it is not necessary that the same offense be
repeated in order to apply the provisions for second or third offense.  Second, third, or
subsequent offenses shall be cumulative from any violations on this list.
TYPES OF DISCIPLINARY ACTION(S) TO BE TAKEN RELATIVE TO THE ABOVE I
THROUGH R OFFENSES FOR LEVEL II OFFENSES:

First offense: 2 ISS to 5 days OSS;
*
Second offense: 5 days OSS;
*
Third offense: Up to 10 days OSS with possible recommendation for
expulsion;
*
Fourth offense: 10 days OSS with recommendation for expulsion.
If a student is suspended out-of-school, a conference with the legal guardian
is required before the student may be reinstated.
A student who has received an out-of-school suspension may not be allowed to
participate in any school sponsored activities or field trips.
       AUTOMATIC LEVEL II. OFFENSES      
A.       Multiple tardies to school as recorded by attendance clerk
                          B.        Use of laser pointers
                          C.        Major disruption in assemblies
                          D.        Public display of affection
                          E.        Disruptive behavior on field trips
TYPES OF DISCIPLINARY ACTION TO BE TAKEN FOR OFFENSES A THROUGH E
ABOVE: AUTOMATIC IN SCHOOL SUSPENSION FOR 2 DAYS FOR THE FIRST
OFFENSE AND EACH SUBSEQUENT INCIDENT.
The administration of the school shall have the right to make allowances as deemed
necessary in assigning the penalty for an infraction.
LEVEL I AND LEVEL  II OFFENSES ARE CUMULATIVE FOR THE YEAR.
A student may not attend any school function within the School District or trespass on
any School District property or ride on any school bus while under suspension or
expulsion or during the appeal process.  At the principal’s discretion, a guardian may
come to school for one full day to attend all activities with his/her child in lieu of each
day of suspension (limit of two days per school year).
The administration reserves the right to use alternate forms of discipline
during the last two weeks of the school year.
C.
CRIMINAL CONDUCT-LEVEL III:
1.
Criminal conduct is defined as student behaviors which result in violence
to oneself or another’s person or property or which pose a direct and
serious threat to the safety of oneself or others in the school.  These
activities usually require administrative action which results in the
immediate removal of the student from the school, the intervention of law
enforcement authorities, and/or recommendation to the Board.
2.
Criminal conduct may include, but is not limited to:
A.
Arson
B.
Assault and battery
C.
Bomb threat
D.
Extortion
E.
Furnishing or selling unauthorized substances
F.
Furnishing, selling, or possession of controlled substances (drugs,
narcotics, or poisons) or any other substance as a means of
stimulation.
G.
Possession, use, or transfer of dangerous weapons
H.
Sexual offenses
I.
Theft, possession, or sale of stolen property
J.
Vandalism (greater than $50)
K.
Knowingly and willfully delivering or conveying to a public official,
teacher, or principal any letter, document, etc., that contains a
threat of death or bodily harm to that person or a member of the
person’s immediate family.
TYPE OF DISCIPLINARY ACTION TO BE APPLIED IN CASE OF CRIMINAL
CONDUCT MAY INCLUDE, BUT IS NOT LIMITED TO:
*
Out-of-school suspension
*
Assignment to alternative school
*
Expulsion
*
Restitution of property and damages, where appropriate, which
should be sought by local school authorities
*
Other sanctions as deemed necessary
Pursuant to State Law, persons entering school property are deemed to have
consented to search of their person and property.  (Act 373 of 1994)
School administrators will contact law enforcement authorities immediately upon
notice that a person is engaging in certain activities on school property or at a school
sanctioned or sponsored activity.  Those activities are ones which may result, or do in
fact result, in injury or serious threat of injury to the person or to another person or
his/her property.
